Thank you for visiting RIMOWA. This Privacy Policy describes RIMOWA’s data collections in our stores, the RIMOWA photo booth (the “Photo Booth”), or on https://www.rimowa.com (the "Site"). The Site and Photo Booth are operated in the United States by RIMOWA Distribution, Inc., a Delaware corporation (“RIMOWA”), with an address of 4325 Windsor Centre Trail, Suite 200, Flower Mound, TX 75028.

 

 

1. GENERAL INFORMATION

 

Protecting the personal data of users and customers is something we take very seriously and we comply with applicable data protection laws.

This privacy policy explains:

 

- what information we collect in connection with the use of or visits to the Site and the functions it offers (e.g. placing an online order via the Site) as well as what information we collect from you when you visit a RIMOWA store or authorized retailer or otherwise engage with RIMOWA (e.g., as a result of a promotion or special offer);

 

- what information we collect when you visit our passport photo booth locations;

 

- what information third parties might collect from you when you use or visit the Site or engage with us on social media; and

 

- how we process, use and share this information.

 

The Site is not designed for, and we do not intentionally collect information from, children or persons under the age of 13. If you are under the age of 13, you may look at our Site but you may not make a purchase or provide us with any confidential information. RIMOWA does not knowingly sell the personal information of minors less than 16 years of age without affirmative authorization.

 

If you decide to provide information to RIMOWA, you are thereby agreeing to the collection, use and disclosure of personal and financial information by RIMOWA under the conditions defined in this Privacy Policy. If you do not accept the terms of this Privacy Policy or any modifications made thereto, please do not continue to use the Site and do not provide RIMOWA with your personal information.

 

2. DATA COLLECTED

2.1 Overview

Depending on the services provided by us and used by you, your choices and the configuration of your computer (with respect in particular to cookies and other trackers), the personal data concerning you (your "Data") collected and processed by RIMOWA mainly includes :

 

- Your first and last name,

- e-mail address, billing and delivery address and telephone number (when placing an order and/or creating an account),

- your credit card or bank account details for the purposes of making a payment,

- your past purchases, your gender, preferences and interests (if you create an account),

- information volunteered by you in connection with surveys conducted by us and

- your connection logs.

 

Your Data is collected for the following purposes :

 

- to answer your questions sent via e-mail, contact forms and chats,

- to enable you to participate in special promotions or offers, - to enable you to create a "MyRIMOWA" personal space or guest account (customer account),

- to enable you to use the Photo Booth,

- to manage any purchase orders that you may place online and their delivery as well as the applicable warranties,

- to register your products online and to get access to additional services,

- to provide you with a better service – e.g. to find the next store or point of contact,

- to ensure the security of your online transactions, or to prevent fraud and payment defaults (see our T&Cs for more details),

- to manage and optimize your customer relationship with us,

- to improve the functionality and appearance of the website or to customize your experience,

- unless you adjust your browser settings as explained in our Cookie Policy, to better understand your preferences by analyzing your behavior on the Site and to offer you products or services more in line with your interests,

- to send you information about our offers, news and events (newsletters, invitations and other publications) - to provide individual communications tailored to your personal product preferences, and

- to carry out analysis and develop statistics about the usage of the Site.

 

Some Data that we collect is mandatory and is marked with an asterisk on the Data collection forms. If you choose not to complete any mandatory fields, we may not be able to process your requests and/or to provide you the requested products and services. Other Data is purely optional and allows us to know you better and to improve our communications and services accordingly. The following explains some, but not all, of the specific activities in which we collect Data:

 

2.2 Registration and customer account ("MyRIMOWA")

The Site gives you the opportunity to register and create a customer account ("MyRIMOWA"). If you create a customer account, you will automatically be allocated a personal RIMOWA number ("MyRIMOWA ID") which is linked to the e-mail address you have provided. You can use your e-mail address for various RIMOWA processes and procedures (e.g. placing an online order). You can also create a customer account independently of a specific online order. You may not create a MyRIMOWA account if you are under the age of 13.

 

In order to create the customer account, we collect the data indicated in the corresponding registration form, in particular your first and last name, billing or mailing address and e-mail address, as well as a password that you select yourself (“Master Data”). The mandatory fields in the registration form must be completed in order to register and create a customer account. When we confirm your registration, we will allocate you a personal MyRIMOWA ID under which we will store your Master Data in our customer database. If you use your MyRIMOWA ID and your customer account for an online order or to use a further service, we will save the data collected in connection with the online order/use of the further service under your MyRIMOWA ID.

 

We can process and use the data stored under your MyRIMOWA account to respond to enquiries about or requests for customer support, for example if you pose a question about registration, about your user account or other functions of your MyRIMOWA account to us, an affiliated company, a RIMOWA retailer or another customer support provider (customer support partner).

 

We may grant customer support partners limited access to the data stored on our customer database as regards your MyRIMOWA account for this purpose, in compliance with data protection regulations (and usually within the scope of a contract stipulating said services). When you pose a request to us or to a customer support partner, the content of this request is stored under your MyRIMOWA account. This personal information is used solely for handling your enquiry.

 

We can also give you the opportunity to register for further services using your MyRIMOWA ID and your login details for the customer account. In this case, your Master Data will also be used for the further service in question. We will provide you with separate information on the handling of your personal data in connection with the relevant further service. You can update or correct any Master Data, including your name, e-mail address, security questions, and other preferences by logging into your MyRIMOWA account and making changes online.

 

2.3 Orders

You can place an online order on this Site even without registering and creating a customer account ("Guest Order"). In this case, too, we need the data that is relevant to the order (in particular your first and last name, billing and delivery address, information on the method of payment and the corresponding payment details) and that you have to enter during the order process. The mandatory fields in the registration form must have been completed in order to place a Guest Order. We save the information that is collected and arises in connection with a Guest Order in our order data-base in order to process the online order and then to fulfil statutory retention obligations.

 

If you place an order (on this website, by phone or in a store) using your MyRIMOWA ID and your customer account, we will save the information that is collected and arises in connection with the order under your MyRIMOWA ID in our customer database; this is also done in order to manage any purchase orders and their delivery as well as the applicable warranties and then to fulfil statutory retention obligations.

 

2.4 Functions of this Site

We also may offer you further functions for which personal data or other information has to be collected, e.g. if you participate in a survey or contest or send us questions or feedback.

 

2.5 Direct Marketing

If you consented, we may send you direct advertising by email based on Data you provide to us. In order to be able to offer this tailored communication, RIMOWA shares with its partners, such as Google, Facebook and Wizaly, some Personal Data, including contact and order details. You can always opt out of receiving direct email communications from us by clicking on an unsubscribe link in any email we send to you.

We may also send you direct advertising by SMS, if you consented. You can always opt out of receiving direct SMS communications from us by replying “STOP” to any message.

Our stores may also contact you by telephone or by SMS text message (with message and data rates applying) if you have provided us with your telephone number to confirm a delivery, verify the status of an order or a repair or to suggest a consultation meeting. You can always opt out of receiving any direct marketing from us by sending an email to dataprotection@rimowa.com.

 

2.6 Connection Logs

We record every time this Site is visited and every time a file stored on this Site is accessed. This pseudonymous information is saved for internal system-related and statistical purposes as well as security reasons. The information recorded includes the name of the file accessed, the date and time of access, the volume of data transmitted, notification regarding successful access, information on the web browser used, the requesting domain and the IP address of the requesting computer.

 

 

2.7 Cookies

In order to make our Site as user-friendly as possible, we – like many other renowned companies – use “cookies”. You can find further information on the various types and the use of cookies and on how to deactivate them in our Cookie Policy. Please note that we do not currently recognize automated browser signals regarding tracking mechanisms, which may include "Do Not Track" instructions.

 

The processing of your personal data described in this section is necessary for the purpose of the legitimate interests pursued by RIMOWA. We have a legitimate interest in direct marketing as long as we comply with the legal requirements for marketing (e.g., requirements for electronic marketing communications).

 

2.8 Website Analysis

We use analysis services on this Site to allow us to record information on the use of this Site (e.g. pages or sections that are particularly popular) and to constantly improve our offering.

 

2.8.1 Google Analytics

This Site uses Google Analytics, a web analysis services offered by Google Inc., 1600 Amphitheatre Parkway, Mountain View, California, 94043 USA (“Google”). Google Analytics uses cookies. The information on your use of the Site collected by the cookie is usually stored on a Google server in the USA, where it is saved. Google will use the information generated using the cookie on behalf of the operator of this Site to evaluate your use of the Site, compile reports on website activities, and provide us with other services associated with the Site and Internet use. The IP address transmitted by your browser to Google Analytics will not be linked to other Google data.

 

You can prevent Google from storing the data generated by the cookie relating to your use of the Site (including your IP address) and from processing this data by downloading and installing the browser plug-in that is available here.

 

2.8.2 BingAds

The Bing service “Bing Ads” & “Bing Remarketing for Search” is used on our website, services of the Microsoft Corporation (“Microsoft”) (Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA). The application involves the operating mode “Universal Event Tracking”. This enables allocating data, sessions and interactions to a pseudonymous user ID across multiple devices and therefore, to analyze the activities of a user across all devices.

 

On behalf of the operator of this website, Microsoft will use this information, to analyze your use of the website, to compile reports on the website activities and to provide the website operator with other services associated with the use of the website and the Internet. Furthermore, these purposes constitute our legitimate interest in data processing. The legal basis for the application of Bing Ads is art. 6 sec. 1 lit. f of the GDPR. If you access one of our web pages via a Bing advertisement, a so-called conversion cookie is stored on your end device. The conversion cookie allows us as well as Microsoft to determine whether a data subject, who accessed our website via a Bing Ads ad, generated revenue; i.e. made or aborted a purchase. Neither we nor other advertisers of Bing Ads obtain information from Microsoft, with which the data subject can be identified.

 

The information collected by the conversion cookie is transmitted to, and stored in, Microsoft servers in the USA. Additionally, your IP address is transmitted to Microsoft servers outside of the EEA. The IP address transmitted by your browser in line with Bing Ads is not consolidated with other data from Bing. Under no circumstances will Bing link your IP address to other data. The collection and storage of data can be objected to at any time effective for the future.

 

2.8.3 Hotjar

This Site uses Hotjar, a web analysis services offered by Hotjar Ltd., 3 Lyons Range, 20 Bisazza Street, Sliema SLM 1640, Malta (“Hotjar”). This service records, on an anonymous basis, interactions between individual visitors to the Site, who are selected at random, and the Site itself. This results in a log showing, for example, mouse movements and clicks, the purpose being to identify potential for improving the Site. Hotjar also uses cookies that are saved on your computer to analyse your use of the Site. In order to prevent information being directly linked to a particular individual, IP addresses are rendered anonymous before they are saved and processed further. Information on operating systems, browsers, incoming and outgoing links, geographical origin and the resolution and type of device is also analysed for statistical purposes. This information does not relate to specific individuals and is not disseminated to third parties either by us or by Hotjar. 2.8.4 Klaviyo

This Site uses Klaviyo. Klaviyo is a multifunctional email platform that is being used for order related communication as well as the sending of newsletters. It will also generate statistical information that might be used to improve our email communication. The Klaviyo tool will be generating statistical information if you have given your consent to receiving the RIMOWA newsletter.

 

2.9 TRACKING AND FACEBOOK PIXEL

We use tracking tools including the Facebook Pixel on this Site to better understand your preferences by analyzing your behavior on our Site and to offer you products or services more in line with your interests.

 

2.9.1 Doubleclick Floodlight Tags

DoubleClick uses cookies to improve advertising. Some common applications are to target advertising based on what’s relevant to a user, to improve reporting on campaign performance, and to avoid showing ads the user has already seen. DoubleClick sends a cookie to the browser after any impression, click, or other activity resulting in a call to our servers. If the browser accepts the cookie, the cookie is stored in the browser. Most commonly, DoubleClick sends a cookie to the browser when a user visits a page that shows DoubleClick ads. Pages with DoubleClick ads include ad tags that instruct browsers to request ad content from our servers. When the server delivers the ad content, it also sends a cookie. But a page doesn’t have to show DoubleClick ads for this to happen; it just needs to include DoubleClick ad tags, which might load a click tracker or impression pixel instead. The Floodlight Tag will only be collecting pseudonymous data in order to track the success of certain RIMOWA campaigns. It is not going to create a personal profile for you. 2.9.2 Facebook Pixel

This Site uses the so-called Facebook Pixel (Website Custom Audience Pixel). This pixel collects information about the usage of this Site (e.g. products you have looked at) and transmits it to Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA ("Facebook"). Facebook uses this information for advertising and profiling purposes. The Facebook Pixel allows us to target you with individualised advertisement in the Facebook network (e.g. in your Facebook account).

2.9.3 Conversion Tags

We may use conversion tags, provided by Conversant Europe Limited. (“CJ Conversion Tags”), for the purposes of correct attribution of our partner’s marketing activity and the performance of our Affiliate program, powered by CJ.

 

You will receive the notice about our use of the Cookies and similar technologies during your first visit of our partners’ web site(s) including request for your consent with use of Conversion Tags. You are the only person who decides if you would like to provide this permission. You can revoke your permission any time.

 

CJ Conversion Tags collect the following data of the order and/or the form completed on our website :

1. unique order ID;

2. quantity of each product purchased;

3. price of each product purchased;

4. currency of the transaction;

5. discount amount (if any);

6. coupon code used (if any);

7. marketing channel the sale is attributed to and a last click timestamp;

8. whether you are a new or existing customer;

9. dynamic CJ event click token captured on landing page URL.

The processing of such data is also subject to Conversant Privacy Policy.

 

2.9.4 Audience Matching Services

We also use audience matching services to reach people (or people similar to people) who have visited our Site or are identified in one or more of our databases (“Matched Ads”). This is done by us uploading a customer list to a technology service or incorporating a pixel from a technology service into our own Site, and the technology service matching common factors between our data and their data. For instance, we incorporate the Facebook Pixel (described below) on our Site and may share your email address with Facebook as part of our use of Facebook Custom Audiences. Some technology services, such as LiveRamp, may provide us with their own data, which is then uploaded into another technology service for matching common factors between those datasets.

 

2.9.5 RTB House

This Site may use RTB House Personalized Retargeting. This service collects information about the usage of this Site and uses the information for advertising and profiling purposes. You have the right to deregister from RTB Personalized Retargeting by clicking here and choosing the relevant option.

 

 

2.9.6 Acuity

This Site may use Acuity Ads. This service collects information about the usage of this site and uses the information to advertise to customers who have online behavior that is similar to a RIMOWA customer site visitor. 2.9.7 Narrativ

We may use conversion tags, provided by Narrativ for the purposes of correct attribution of our partner’s marketing activity and the performance of our marketing program, powered by Narrativ. 

 

2.9.8 Attentive

We may use conversion tags, provided by Attentive for the purposes of correct attribution of our partner’s marketing activity and the performance of our marketing program, powered by Attentive. 

 

2.9.9 LiveIntent

We may use conversion tags, provided by LiveIntent for the purposes of correct attribution of our partner’s marketing activity and the performance of our marketing program, powered by LiveIntent. 

 

 

2.9.10 TikTok

2.9.12 Epsilon

We may use the Epsilon tags to collect information about your usage of this Site (e.g. your IP address, transactional information and browsing activity) and transmit it to Epsilon. Epsilon will use this information for interest-based advertising and profiling purposes. The Epsilon tags allow us to show you personalized advertisement through the devices of internet-connected television (CTV).

2.10 SOCIAL PLUGINS


"Social plugins" for a number of social networks have been incorporated into this Site. These allow you to recommend content and offerings available on our Site to your friends and other people you know. These social plugins include Facebook, Google+, Twitter, YouTube, Weibu, WeChat and LinkedIn. As the Site provider, we are not aware of the content of the data transmitted or the manner in which it is used by any of these social media companies. You can find further information on the handling of your data by them in their own data privacy policies.

Our social plugins are not activated by default. If you choose to activate a social plugin by clicking on it, you can transmit data to the operator of the social network in question. This data can include, in particular, your IP address, browser information and operating system, screen resolution, installed browser plugins such as Adobe Flash Player, where visitors originated from if they followed a link (referrer), the URL of the current page or in-formation on the use of a certain service on this Site.

 

2.11 RIMOWA PHOTO BOOTH

RIMOWA may offer a photo booth which will take individual US passport photographs. If you choose to use the passport photo booth, we will ask for your consent to collect your first name, last name, email address, photograph, zip code and country of residence. We will save all your information and use your email address for marketing purposes, but will delete the photo that is taken by the photo booth as soon as reasonably possible.

 

Our social plugins are not activated by default. If you choose to activate a social plugin by clicking on it, you can transmit data to the operator of the social network in question. This data can include, in particular, your IP address, browser information and operating system, screen resolution, installed browser plugins such as Adobe Flash Player, where visitors originated from if they followed a link (referrer), the URL of the current page or in-formation on the use of a certain service on this website.

 

The processing of your personal data described in this section is necessary for the purpose of the legitimate interests pursued by RIMOWA: We have a legitimate interest in processing our user’s data upon their request if they activate the plugin and request to share information with a social network. The section below provides you with information on the social plugins on this website. 3. RECIPIENTS OF THE DATA

Your Data shall be processed by RIMOWA. It is not going to be transferred or made accessible to any third party with the exception of (i) subcontractors or service providers of RIMOWA (e.g., carriers, providers of hosting and maintenance services of the Site, payment and fraud management service providers, web analysis providers etc.), (ii) with third parties offering tracking technologies or social plugins (e.g. Facebook plugin, Google+, Twitter) as described above, and (iii) in case of a reorganisation of RIMOWA, such as a total or partial transfer of assets, merger, takeover, de-merger, and in general any reorganisation transaction, including at the negotiation stage.

 

Your Data may be disclosed to affiliated companies of RIMOWA for purposes of management and optimization of the customer relationship, and to send you information about the offers, news and events of RIMOWA and its affiliated companies. These affiliated companies include RIMOWA GmbH and its subsidiaries.

 

Finally, RIMOWA may disclose your Data to third parties if such disclosure is required by law, by a regulatory provision or by a court ruling, or if this disclosure is necessary to ensure the protection and defense of its rights.

 

In order to be able to offer you Klarna’s payment options, RIMOWA sends to Klarna some personal information, such as contact and order details, in order for Klarna to assess whether you qualify for their payment options and to tailor the payment options for you. General information on Klarna you can find here. Your personal data is handled in accordance with the information in Klarna´s privacy statement.

  

In addition, you can also use payment options provided by Apple Pay on the Website. In this case, your Personal Information is processed in accordance with the information in Apple Pay privacy statement.

In order to ensure the security of online transactions, prevent fraud and payment incidents when you are visiting the Website, RIMOWA sends to Forter, its fraud management service provider, some Personal Information, such as contact information, transaction data, account information, browser, device and connection data. This processing of your Personal Information is based on the legitimate interest of RIMOWA to ensure security and fraud detection. Your Personal Information is processed in accordance with applicable data protection law and in accordance with the information in Forter privacy statement.

4. TRANSFERS OF DATA ABROAD

We may transfer your Data outside of the United States. In such cases we ensure prior to the transfer that the transfer is subject to appropriate safeguards.

A copy of the safeguards implemented by RIMOWA as well as an overview of third country recipients may be obtained by sending a request to RIMOWA by email at dataprotection@rimowa.com or by mail to RIMOWA, 2200 W 32nd Street, Box 619024, DFW Airport, TX 75261.

 

5. RETENTION PERIOD OF YOUR DATA

The Data that is collected and processed under the "Contact" section shall only be kept for the duration of the processing of your request. It shall be deleted thereafter.

 

Should you decide to create a customer account, your identification Data shall be kept for as long as your account is active and you do not close it. You may close your account at any time. Should your account remain inactive for three (3) years, RIMOWA shall contact you to find out whether or not you wish to maintain your account. Should you not wish to maintain it, your account shall be closed and your Data shall be destroyed.

 

The Data concerning your purchase orders shall in principle be kept by RIMOWA for a period of time that does not exceed the applicable statutory limitation periods. This Data may however also be viewed from your customer account as long as the latter remains active. Upon closure of your customer account, this Data (i) shall be archived for accounting and evidentiary purposes for the abovementioned statutory limitation periods, or (ii) shall be destroyed if these periods have expired.

 

Your bank account Data shall be kept secure for the duration that is needed for the confirmation of your purchase order and its payment and shall then be immediately destroyed. In case of a payment default, your Data shall be kept throughout the duration of the management of the incident, and thereafter for a period of three (3) to five (5) years depending on the seriousness of the incident.

 

The Data that is used for the purpose of sending you information concerning the offers, news and events of RIMOWA shall be kept for a period of three (3) years as from the date on which it was collected or as from your latest contact with RIMOWA. Upon expiry of this timescale, RIMOWA may get in touch with you to find out whether you wish to continue to receive information about our offers, news and events. Such Data shall be deleted within a maximum of one (1) month following any request on your part to unsubscribe.

   

IP addresses collected for security purposes will not be stored for longer than 10 days. Finally, the connection logs that are collected, subject to your consent, using cookies and other trackers implemented on our Site, shall be kept in accordance with applicable laws and regulations for a period of time that does not exceed thirteen (13) months. 6.1 CALIFORNIA PRIVACY

California Civil Code Sections 1798.115(c), 1798.130(a)(5)(c), 1798.130(c), and 1798.140 indicate that organizations should disclose whether certain categories of information are collected, “sold” or transferred for an organization’s “business purpose” (as those terms are defined under California law). We do not “sell” your personal information. You can find a list of the categories of information that we collect and share here. Please note that because this list is comprehensive it may refer to types of information that we share about people other than yourself. If you would like more information concerning the categories of personal information (if any) we share with third parties or affiliates for those parties to use for direct marketing please submit a written request to us using the information in the "Contact Information" section below. We do not discriminate against California residents who exercise any of their rights described in this Privacy Policy.

  

If you are a California resident you have the right to ask (1) that we grant you access to the personal information that we have about you, and (2) that we delete the personal information that we collected from you. In certain circumstances we may not be able to honor your access or deletion request. Note that, as required by law, we will require you to prove your identity. We may conduct an identity verification by phone call or email. Depending on your request, we will ask for information such as your name, the last item you purchased from us, or the date of your last purchase from us. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete personal information about you in our files.

1. You must provide us with a copy of a written and signed permission given to your authorized agent; and

2. You must verify your own identity directly with us.

 

 

7. COLLECTION OF DATA ON THIRD-PARTY WEBSITE

Links on this Site may take you to third-party websites that are not within our sphere of control (including via social plugins). As a result, please read the terms and conditions of use and data protection information on those websites to find out more about the collection, processing and use of (personal) information on those websites.

 

 

8. SECURITY
